Turkish work permit

Immigration in Turkey is regulated by the General Directorate of Immigration Management (Turkish: Göç İdaresi Genel Müdürlüğü) under the supervision of the Ministry of Interior while work permits are delivered by the General Directorate of Labor Immigration (Turkish: Uluslararası İşgücü Genel Müdürlüğü) under the supervision of the Ministry of Labor and Social Security (Turkish: Çalışma ve Sosyal Güvenlik Bakanlığı). All applications for both residence permit and work permit are made through online government portals. The residence permit application is made through "e-Residence" (Turkish: e-İkamet) while work permit application are made through "e-Government" (Turkish: e-Devlet).[1]

Turkish law requires companies willing to employ foreigners to have a paid capital of at least 100,000 Turkish lira and five Turkish workers for every foreign worker they are wishing to employ.[2]

Work permit types

Even if the work permit in Turkey is given to the foreign citizen it is affiliated with the company where the foreigner is planning to work. Several types of work permits are available for foreigners in Turkey according to their profession, skills and stay duration.[3]

Work permit for a specified period

The work permit for a specified period of time allows a foreign worker to work in a definite geographical zone, in an appointed profession, for an appointed employer, for a specific time period and with a validity of at most one year for the first time. It is renewable every year with the possibility to expand the time of validity by a year, every year, if the employee is working for the same employer.[4] This kind of work permit may be applied from both inside the country, with application made to the Ministry of Labor and Social Security, as well as abroad the country, with application made at the Turkish Consulate.[5]

Work permit for an indefinite period

The work permit for an indefinite period of time allows a foreign worker to work in Turkey without any geographical zone, profession, appointed employer or time period limitation. Holders of this work permit haven't the restrictions of the Turkish labor market consideration. However to be granted the work permit for an indefinite period of time the applicant must have been living or working in Turkey continuously for at least eight years legally in Turkey.[4]

Independent work permit

The independent work permit allows a foreigner to work for any company or for him/her own behalf and account without any geographical zone, profession, appointed employer or time period limitation. Holders of this work permit haven't the restrictions of the Turkish labor market consideration. The main difference with the work permit for an indefinite period of time is the independent work permit allows the holder to establish his own company or business legally in Turkey. However to be granted the independent work permit the applicant must have been living continuously in Turkey for at least five years. Under new law shareholder managers of limited companies, shareholder members of board of Joint Stock Companies and shareholder managers of Commandite Companies are required to obtain work permit.[4]

Exceptional work permit

The exceptional work permit is given to foreigners wishing to work in Turkey who will be excepted from the Ministry of Labor and Social Security's requirements. Exceptional work permit are granted upon the investigation of the Ministry of the Interior on the case applied for.[6]

Turquoise card

The turquoise card allows a foreigner the same rights as the work permit for an indefinite period of time with a duration of at first three years. It also grants the holder's spouse and dependent children the right to stay in Turkey for the duration of the permit. The turquoise card will be delivered through the recommendation of the Turkish International Labor Force Council by considering several factors such as the education level of the applicant, their professional experience, their contribution to science and technology, and the impact of activities and investments in Turkey on the economy and employment.

While the turquoise card has been approved by the Turkish government on 28 July 2016 and the main conditions have been determined, some details concerning the details of the card and the criteria of eligibility are still pending.[7]
